Power of Attorney for a Leased Car in the UAE

A power of attorney for a leased car lets someone act for you on your side of the lease while you are away: attending the return inspection, signing the handover sheet, agreeing an early termination or disputing a damage charge. It usually does not let them renew, sell or transfer the car, because in most leases the car is registered to the leasing company, not to you. Check the owner named on the registration card before deciding what the document needs to say.

Who owns a leased car in the UAE?

Look at the registration card (Mulkiya). In most car leases the owner named there is the leasing company, and you hold the car under the lease contract. That split decides what a power of attorney can do.

Anything that belongs to the registered owner, such as renewing the registration or transferring the car, is the leasing company's step with the vehicle licensing authority. In Dubai, RTA's renewal service is for "the ownership of the vehicle registered in Dubai" (RTA, renew and amend vehicle ownership), which is the owner's transaction. Anything that belongs to you under the lease, such as returning the car or answering a charge, is where your representative can help.

What can a power of attorney for a leased car cover?

Only the acts it lists. For a lease, people usually ask for authority to:

• Attend the return or handover inspection and sign the inspection sheet
• Receive and answer the leasing company's damage or excess-mileage charges
• Agree an early termination on the terms the lease allows, and sign the termination papers
• Collect a refund of the security deposit
• Deal with correspondence and statements under the lease

Whether the leasing company accepts a representative for any of these is its decision. Ask it in writing before drafting what it needs from someone acting for you.

Is a car-lease dispute a Rental Disputes Center case?

It should not be assumed to be. Dubai's Rental Disputes Center is built around property tenancies: its case fees are calculated as a percentage of "Annual Rent or Lease Value", and its filing list begins with "A copy of latest lease (Ejari)" (Rental Disputes Center, first-instance case). Ejari is Dubai's registration system for property tenancy contracts, not for car leases.

A disagreement with a car-leasing company is a contract matter. If it cannot be settled directly, ask a licensed lawyer which forum applies before relying on any document. What documents are usually needed?

• The lease contract and the leasing company's name
• The registration card (Mulkiya) and plate number
• Any written requirement the leasing company has given for a representative

Usually, if the leasing company accepts a representative and the document authorises the return and the signing of the inspection sheet. Ask the leasing company first what it needs.

Can a power of attorney let my representative renew the registration of a leased car?

Usually not, because renewal is the registered owner's transaction, and in most leases the owner is the leasing company. Check the owner named on the registration card.

Can my representative dispute a damage charge at the end of the lease?

Yes, if the document authorises dealing with charges under the lease. They can receive the charge, question it and respond in writing. Whether the charge stands is between you and the leasing company.

Should I cancel the power of attorney after the car is returned?

Once the lease is closed there is nothing left for it to do, and a document with a set end date avoids the question altogether. Revocation is usually a separate formal step with the notarising authority.
